TEMPLATE LETTER FROM A TENANT/RESIDENT GROUP REQUESTING SIGHT OF A HOUSING ASSOCIATION FIRE RISK ASSESSMENT
Dear Chief Executive,
At the last meeting of the [INSERT NAME OF TENANT/RESIDENT GROUP] it was decided to request a full and complete copy of the most recent Fire Risk Assessment completed by [INSERT NAME OF HOUSING ASSOCIATION] that covers [INSERT NAME OF STREET/ESTATE/AREA].
In the aftermath of Grenfell, I am sure you will be more than sympathetic towards the concerns that people have in relation to fire breaking out in their homes.
Article 5 (3) of the Regulatory Reform (Fire Safety) Order 2005 places a duty in respect of Articles 8 to 22 (which includes the Fire Risk Assessment) on the responsible person, in respect of premises; and imposes these duties upon every person (other than the responsible person) who has to any extent, control of those premises, so far as the requirements relate to matters within their control. Tenants and residents fall under the provision of Article 5 (3) by virtue of Article 5 (4), our ‘tenancy’; with particular emphasis on sub-section (b) ‘the safety of the premises’.
We therefore wish to satisfy ourselves that –
- a suitable Fire Risk Assessment has been carried out by yourselves; and
- we understand fully what duties may have been placed on ourselves as tenants in relation to that Assessment and to ensure that these are made fully known to and understood by all tenants.
I am therefore writing to you on behalf of the [INSERT NAME OF TENANT/RESIDENT GROUP] to request a full and complete copy of the most recent Fire Risk Assessment completed by [INSERT NAME OF HOUSING ASSOICIATION] that covers [INSERT NAME OF STREET/ESTATE/AREA].
